Welcome to manifestogames.com. Manifesto Games and our affiliates provide our services to you subject to the following conditions. If you visit or shop here, you accept these conditions. Please read them carefully. In addition, if you follow a link we provide to a partner, you may be subject to whatever conditions they apply.

Copyright

Anything you post on the Manifesto Game site, including but not limited to reviews, comments, and forum posts, remains your property, and you retain copyright in it. However, you grant us a perpetual, non-exclusive, non-revocable license to display your posts to any and all users of the site, and to use them in any promotional or marketing context we deem useful. You may not quote or use the posts of other site users without their individual permission, except as permitted under the fair use provisions of copyright law. All other content on this site, including graphics, text, logos, digital downloads, and software is the property of Manifesto Games, Inc., or its content partners, and is protected by US and international copyright laws. In some cases, specific pieces of content may be released under a Creative Commons copyright notice, in which case the page in question will contain a notice stating this, also stating what content is so released, and linking to a Creative Commons description of the rights that others may use; in such case, the terms of that notice apply to the use of the described content.

Service and Trademarks

Manifesto Games and the Manifesto Games logo are service marks; the titles and logos of many products offered here are trademarks of our distribution partners. These trade and service marks may not be used in connection with any product or service that is not Manifesto Games's, or in any manner that is likely to confuse customers. All other trademarks not owned by Manifesto Games that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Manifesto Games or its affiliates; the use of any such trademark is not to be construed as a challenge to its trademark status.

Electronic Communications

Any agreement or notice that may be sent by us to you, via email or via a response to a posting on the site, is an electronic communication; you agree that any notices, disclosures, agreements, orother communications that we provide to you electronically satisfy any legal requirement that these must be in writing.

License and Site Access

Manifesto Games grants you a limited license to access and make use of this site, but not to use any copyrighted or trademarked material here without specific permission in writing, unless authorized by a particular Creative Commons notice. The license does not permit you to resell or make any commercial use of material here, including use of compilations or data derived by Manifesto Games, or any derivative use of the content (except, again, as specified by particular Creative Commons notices). This site, or any portion of it, may not be reproduced, framed, downloaded, duplicated, sold, or exploited for any commercial purposes except with our specific written permission. Any unauthorized use terminates your license to use this site. You are free, however, to link to this site, or to any specific page within it, as you wish.

Your Account

You are responsible for maintaining the confidentiality of your userID and password, and accept responsibility for any use that occurs using that userID and password. We reserve the right to terminate your account, limit its use, edit or delete any content that you provide, or cancel any order you place, in our sole discretion.

Age and Adult Content

Manifesto Games sells a wide variety of content, some of which is not appropriate for children, and some specifically geared for children. In some cases, content that is not appropriate for children has not been rated by an external rating authority; we make a good faith effort to identify unrated content that is inappropriate for children as such, but do not accept responsibility for any failure to do so. Additionally, Manifesto Games's standards of what content is suitable or unsuitable for children is at our sole discretion, and parents or custodians of minors should be aware that their standards of suitability may differ from our own. If, however, you feel that we have erred in our assessment of the suitability of a particular item, we invite comment and suggestion on the matter; whether or not we choose to act on such a comment or suggestion is purely at our discretion.

Manifesto Games asks its customers to indicate whether they are over the age of 18 or not, and will not display content it deems unsuitable to minors to customers who say that they are not. However, this measure is not completely secure, and if you allow your children or wards to use this site, you understand and acknowledge this fact.

User-Supplied Content

Manifesto Games allows, and indeed encourages, visitors to post reviews, comments, and to our forums. However, you agree that you will not submit any material that is illegal, obscene, threatening, libelous, defamatory, invasive of privacy, infringing upon intellectual property rights, or otherwise injurious to third parties; and any content you post must be free of software viruses, spyware, and other forms of malware; nor may it contain commercial solicitations, chain letters, mass mailings, or any other form of spam.

You continue to own the copyright in any material you supply, subject to the grant to Manifesto Games described in "Copyright" hereinabove. You represent and warrant that you own or otherwise control the content of anything you post or supply; that the content is accurate; that use of the content by Manifesto Games does not violate this policy or cause any injury to any person or entity; and that you will indemnify Manifesto Games or its affiliates from any claims resulting from our use of any content you supply. We have the right but not the obligation to monitor all supplied content and to edit or remove it. Manifesto Games takes no responsiblity for content supplied by third parties.

Disclaimer of Warranties and Limitation of Liability

Manifesto Games provides this site on an "as is" and "as available" basis. We make no implicit or explicit representations or warranties of any kind as to the usability, accuracy, applicability, availability, or safety of any content, materials, or products available through this site. You use this site at your own risk.

Manifesto Games makes a good faith effort to ensure that any email we send, any other electronic communication with users, and any software downloaded from this site is free from viruses or other harmful components. However, much of the software we provide is supplied to us by third parties, or supplied via an affiliate relationship with other portals; when software is provided directly by us, or through our relationship with Amazon S3, the third party that provides it to us is contractually obliged to us to ensure that it is free of viruses or other harmful components. Despite this contractual arrangement, we cannot guarantee that the software is indeed free of such things. Similarly, when we link to an affiliate partner for a download, we have no control over what the software they supply contains, although it is our policy not to have such relationships with any partner we believe to include viruses or other harmful components in their software. Applicable Law

By visiting manifestogames.com, you agree that the laws of the state of New York will govern these Terms of Use and any dispute of any sort that might arise between you and Manifesto Games or its affiliates.

Disputes

Any dispute relating in any way to your visit to this site or to products you purchase through it shall be submitted to confidential arbitration in the state of New York except that, to the extent you have in any manner violated or threatened to violate the intellectual property rights of Manifesto Games or our distribution partners, Manifesto Games may seek injunctive or other appropriate relief in any state or federal court in the state of New York, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
