Privacy Policy

What Information do You Store About Me?

We record any information you give us (name, credit card, and so on); in most cases, you can decide not to give us information, but in some cases failing to do so means you don't get access to site features (like, it's hard for us to sell you something without a credit card number). We use this information to communicate with you, provide various services (e.g., highlighting games from genres you like), and so on.

We also record some information about your activities on the site, including but not limited to what you've downloaded, what you've posted, what games you've ranked, and so on. Mostly this is kept in a database on our server, but some may be in the form of cookies on your machine. The purpose is to serve you better by doing things like being able to recommend games that people who bought what you bought like, make sure people don't abuse the game rating system, and so on.

What Information Do You Share With Others?

We do not sell email addresses or other information about our customers to marketing companies. However, in some limited number of a cases, we may share some information about you:

  • When you buy a game we offer that was developed or published by another company (which is true of, well, all the games we offer at present), in some cases we will pass on your email address to that company. We require them not to sell your email address to anyone else, but do allow them to use the address to inform you of updates, patches, or expansions for the game you purchased, or to market their other games to you. If you select "Do not share my email address" on your profiles page, we will do this less often--BUT in some cases, we're contractually obliged to pass on the email addresses of purchasers of certain games, so we will do so anyway.
  • When we sell a physical item (such as a boxed version of a game, or a t-shirt), we work with third parties to fulfill those orders (we don't run our own warehouse). In this case, we pass on your name, address, and so on, so that the order can be properly fulfilled. Similarly, we use third parties to process credit cards, and can only do so by sharing your credit card information with them. In other words, these third parties have access to the information they need to fulfill their function, but may not use it for other purposes.
  • We will release information to duly authorized law enforcement personnel when required to do so by law. We will use information we have about you to enforce our terms of service; and to protect the lives, property, or safety of our employees, customers, or others. We may also share information with third parties for the sole purpose of fraud protection and credit risk reduction.
  • We will release information about you otherwise only with your consent.

What about Links Offsite

In addition to selling games ourselves, we often link to places where you can obtain games that are operated by others, and for which we are not responsible. In some cases, we have an affiliate marketing or other contractual relationship with these companies, under which we receive some portion of whatever money you may spend with them; in other cases, we do not, and simply provide such links because we think the games they provide are interesting. We do make an effort not to send you to places that are going to do nasty things like try to install viruses or spam you. However, we can't be responsible for what third parties do, and have no control over their own privacy policies (or other policies). If you think we're linking someplace inappropriate, do please let us know, however.

Do you Participate in the EU "Safe Harbor" Program Regarding Privacy?

Well, no. Probably we will at some point in the future, but we haven't gone through the enrollment process yet. Regardless, it is our objective to abide by EU privacy laws even before we do so.
